Court Fees Go Up on Monday 9th March 2015
The Lord Chancellor, Mr Chris Grayling has substantially increased the Court Fees for Claimants to commence legal proceedings. This is the second increase in less than twelve months.
The Civil Proceedings and Family Proceedings Fees (Amendment) Order 2015 will increase the Court Fees on Monday 9th March 2015.
The Claimant will have to pay an upfront Court Fee up to £10,000 an increase in some cases of 622% than the current fees.
- There is no change for claims below £10,000.
- The claims between £10,000 ad £200,000, the Court Fee will be 5% of the value of the claim.
- The Court Fee for claims above £200,000 is capped at £10,000.
- If proceedings are started by a money claim on line there will be 10% discount on fees.
The Judiciary have raised its concerns that this may restrict access to justice for those facing higher fees.
This will also deny sole traders, small business and individual claimants to exercise their legitimate right. The Debtors are less likely to pay if they suspect that the Claimants are unable to pay the Court Fees. Unfortunately Mr Grayling has created a Debtors Charter as some unscrupulous Debtors will not pay the debts.
