The Employment Tribunal System
The Employment Tribunal System changed with effect from Monday 29th July 2013.
An Employment Tribunal hears cases and makes decisions on claims to do with Employment Law such as Unfair Dismissal, Discrimination and range of other claims. To make a claim in an Employment Tribunal you must provide certain information. Your claim will not be accepted unless it meets certain conditions. There are also strict time limits. You will also have to pay a fee, or apply for remission. You are able to make a claim on line, by post or deliver by hand.
There are two fee levels based on the type of claim. An Employment Cases will be split into Type “A” and Type “B”. The fees for Type “A” cases are an issue fee of £160 and a Hearing Fee of £230. The fees for Type “B” cases are an issue fee of £250 and a Hearing Fee of £950. The party will also have to pay additional fees for counterclaim, judicial mediation, applications for review and appeals.
The remission from the fees is available on the grounds of low income, limited or no savings or when the Claimants are in receipt of State Benefits. You will receive either a full remission or part remission based on the money you receive and money you spend each month.
In future the Claimant will also have to obtain a Certificate from ACAS prior to making an application to the Employment Tribunals. ACAS have recently launched a new 24 hour Advice Service on line.
